By week's end, the evidence that George W. Bush, Dick Cheney, Donald Rumsfeld and other top government officials had deliberately created a system of torture which they knew was illegal – indeed, a capital crime – under U.S. law was so plain, so overwhelming, and so handily concentrated that it broke through the levees of institutional cover-up and media complicity that had held this clear truth at bay for so long. The grim facts had finally worked their way into "conventional wisdom." It was now permissible for good "centrist" folk to speak of such things, even condemn them, without being automatically relegated to ranks of "the haters," the "unserious," the "shrill partisans," etc.

And yet, even as this new consensus was forming, you could see the sandbags piling up in the background to make sure that the water didn't reach too far. A line of defense was being laid that would allow the purveyors of conventional wisdom to vent a bit of righteous outrage at official wrongdoing without actually having to do anything about it or admitting of any flaws in their fundamentalist doctrine of American exceptionalism. No one need take any risks, make any effort, or discomfort themselves in any way to rectify the injustice; indeed, even the perpetrators should be left undisturbed. The major premise of Bugliosi's case against Bush is that the former Texas governor, who unapologetically executed more death row inmates than any other governor in the country (and joked about killing one of them), intentionally lied and deceived the American public while he was president about the reasons for going to war in Iraq, which has caused the deaths of over 4,000 U.S. service men and women and over a 100,000 Iraqis.

But how can Bush be prosecuted and convicted of murder if he personally did not kill anyone? Bugliosi asks, and then answers his own question: "...it is not necessary for a criminal defendant to have physically committed a murder to be guilty of it. For example, I convicted Charles Manson of the seven Tate-La Bianca murders even though he himself did not participate in any of the killings, nor was he present at the time."

Interesting comparison. Bush and Manson - two twisted sociopaths who revel in death and destruction. But Bugliosi goes further: "I was able to obtain this conviction because of the vicarious liability rule of conspiracy, which provides that each member of a conspiracy is criminally responsible for all crimes committed by his coconspirators... Necessarily, (Bush) conspired with certain members of his inner circle, co-conspirators like Dick Cheney and Condoleezza Rice." [More]

Drawing from a host of media reports, a jig-saw-puzzle picture of sexual torture employed in the War on Terror begins to emerge. Scotland’s Sunday Herald reports that a former Iraqi prisoner claimed that there is a photo of a civilian translator raping a male juvenile prisoner; he stated, “They covered all the doors with sheets. I heard the screaming… and the female soldier was taking pictures.”... Such interrogation practices were not limited to Iraq. According to a report in the Sydney Morning Hearld: “Female interrogators tried to break Muslim detainees at Guantanamo Bay by sexual touching, wearing a miniskirt and thong underwear and in one case smearing a Saudi man's face with fake menstrual blood"...

The clock is ticking down on the Bush administration. For all their respective protestations, one can only wonder whether the next president will (secretly) approve the use of cruel, humilating and degrading interrogation techniques, especially sexual terror. Hidding behind plausible deniability is one of the oldest practices of those in power. Morality and the law nearly always take second place to expedience and necessity, whether real or invented. A week later, it has still not been reported in the New York Times, the nation’s self-described “newspaper of record,” even though the Times had just days before Rep. Kucinich’s action, editorialized about the enormity of the president’s lies in tricking the country into invading Iraq — one of the crimes leading Kucinich’s long list....

The unwillingness of the nation’s news media to seriously consider the need for Congress to respond to and challenge the president’s clear abuses of power—even as they themselves condemn of those abuses of power—is a blot on the journalistic profession perhaps worse, and of more lasting consequence, than their failure to act as watchdogs and critics during the run-up to the Iraq War, when they acted more as patriotic cheerleaders than as news organizations. On the fifth anniversary of the illegal occupation of Iraq, Bush offered more illogic - that the invasion has made the world a better place and the United States safer... Clearly, George Bush lacks the ability to recognize facts. So, he creates his own reality, one unique to him and to supporters with whom he holds sway. And he stands behind his decisions even when experts differ. Bush listens only to people who agree with him and either scorns or forces retirement on those who don't...

Bush can't grasp that he is, was, or ever could be wrong. Many believe he has no conscience to guide him. Tragically, this means Bush lacks the capacity to understand that he, himself, is the brutal tyrant responsible for countless deaths and disasters. And, so, removing him from power is not only the right decision, it is crucial. We are told the “surge is working”, whereas it is the U.S. military’s abandonment of its brutal home invasions that has led to the lull. Insurgents still control their own terrain. Meanwhile hundreds of thousands of Iraqis face the prospect of malnutrition and outright starvation, which is not newsworthy. Bush psychopathy stretches from the Middle East to the White House, where it is widely suspected that prior to its illegal erasure, the CIA torture tape was screened for the pleasure of the President.

Looking back over the terror war years, we can now contemplate accusations of high crimes & misdemeanours that once seemed impossible. The recent announcement that eight U.S. State Department veterans challenge the official account of 9/11 is likely to flush out more witnesses. Mainstream media are too embedded with the power elite to conduct an impartial yet vigorous evaluation of the evidence relating to dirty deeds on 9/11. "Among those being briefed, there was a pretty full understanding of what the CIA was doing," the report quotes former director of the CIA Porter Goss as saying. "And the reaction in the room was not just approval, but encouragement.”

Shame on those members of Congress who were briefed and kept silent. Shame on those in the Administration who were complicit and acted moral and indignant when questioned about torture. Shame on a complicit media for not boring in and exposing this madness. Shame on those in America who will applaud this brutal and deadly practice.

There is little question that the majority of people on the planet - those who suffered under both the corporate globalization of the Clinton years and the imperial globalization of George W. Bush - deserve something better. However, it is far from certain that social justice advocates who want to encourage a more democratic approach to world affairs and global economic well-being will be able to sway a new administration. On the other hand, the damage inflicted by eight years of neocon rule and the challenges of an increasingly daunting geopolitical scene present a conundrum to the corporate globalizers: Is it even possible to go back to the way things were?...

Battered by losing wars and economic crisis, the USA is now a superpower visibly on the skids. And yet, there is no guarantee that the coming era will produce a change for the better. In a world in which the value of the dollar is plummeting, oil is growing ever more scarce relative to demand, and foreign states are rising as rivals to American power, the possibility of either going ahead with Bush/Cheney style unilateralism or successfully returning to the "enduring and effective" multilateral corporatism of the 1990s may no longer exist. But the failure of these options will undoubtedly not be for lack of trying. Even with corporate globalization on the decline, multinational businesses will attempt to consolidate or expand their power. Afghanistan was supposed to be "the Good War". Originally, 95% of the American people supported the invasion as the proper response to the attacks of September 11. Liberals and conservatives alike joined the rush to war. The world needed to see America's iron-fisted wrath. It was "payback time". Tariq Ali called it, "A crude war of revenge". He was right. No one talks about caves anymore - or smoke. The pre-war zeal is gone. Vanished. The "hearts and minds" campaign is lost, too.

"Far more civilians have been killed by the U.S. military in Afghanistan than were killed in the U.S. in the tragedy of September 11. The Bush administration has reneged on every commitment it made to the Afghan people. There was never any attempt to provide security beyond the capital. Never.
